Federal Share of Cost
Section 130 projects are typically funded 100% by Federal funds. California’s Federal apportionment through the Infrastructure Investment and Jobs Act (IIJA) is approximately $17million per year.
Projects funded in this program must be included in the appropriate Federal Transportation Improvement Program (FTIP) developed by the Metropolitan Planning Organization (MPO) and the Federal Statewide Transportation Improvement Program (FSTIP) approved by the Federal Highway Administration (FHWA).
Once projects have been included in the FTIP/FSTIP, the RHCP manager is able to complete the E-76 in the Federal Aid Data System (FADS). After funds are authorized, Caltrans RHCP can draft concurrent contracts with the railroad and applicable local agency for each Section 130 project throughout the State. Each contract is reviewed by Caltrans Legal prior to execution.
Invoicing
Invoices must be sent at least quarterly for each contract to remain active. Complete the LAPM 5-A Form which can be found on the LAPM Forms website. Additional information regarding invoicing can be found in the LAPM. Submit all Section 130 invoices to Todd Rogers, todd.rogers@dot.ca.gov.
TIME EXTENSIONS
Section 130 program projects are safety projects and are expected to be completed in a timely manner. If a time extension is anticipated, it should be immediately brought to the attention of the Caltrans for a review of the justification for the schedule change, at least 90 days before the contract expiration. If this increase in schedule change is adequately justified and approved by the CPUC and Caltrans, an amendment to the existing contract will be initiated and provided to the local agency and/or railroad company.
COST INCREASE
Contract amounts are established based on initial estimates agreed upon by all parties. Any contract cost increases must be requested and approved by the Caltrans Section 130 Program Manager.
